{"id":367,"date":"2009-03-19T16:44:27","date_gmt":"2009-03-19T22:44:27","guid":{"rendered":"http:\/\/cookcountypd.org\/blog\/?p=367"},"modified":"2009-03-19T17:47:32","modified_gmt":"2009-03-19T23:47:32","slug":"burnette-v-terrell-decided-by-illlinois-supreme-court","status":"publish","type":"post","link":"https:\/\/local3315.org\/blog\/index.php\/2009\/03\/19\/burnette-v-terrell-decided-by-illlinois-supreme-court\/","title":{"rendered":"PDs Win &#8230;Judge Terrell Loses"},"content":{"rendered":"<div>In a <span id=\"lw_1237506081_0\" class=\"yshortcuts\" style=\"background: none transparent scroll repeat 0% 0%; cursor: hand; border-bottom: medium none;\">unanimous decision<\/span> from the <span id=\"lw_1237506081_1\" class=\"yshortcuts\">Illinois Supreme Court<\/span>,\u00a0\u00a0the Court, exercising its supervisory powers, ruled that J Terrell, and by implication all other judges, may not pick and choose which public defender is assigned to which defendant.\u00a0 Writing for the court, Justice Garman states:<\/div>\n<div>\u00a0<\/div>\n<div><em>We conclude that because <span id=\"lw_1237506081_2\" class=\"yshortcuts\">assistant public defenders<\/span> serve at the<br \/>\npleasure of the public defender (55 ILCS 5\/3\u20134004, 3\u20134004.1 (West<br \/>\n2006)), <strong>the public defender has the sole statutory authority to make work assignments to the assistant public defenders<\/strong>.
