{"id":292,"date":"2009-01-25T14:05:54","date_gmt":"2009-01-25T20:05:54","guid":{"rendered":"http:\/\/cookcountypd.org\/blog\/?p=292"},"modified":"2009-01-25T14:11:09","modified_gmt":"2009-01-25T20:11:09","slug":"trial-court-must-rule-on-admissibility-of-defendants-priors-before-heshe-hits","status":"publish","type":"post","link":"https:\/\/local3315.org\/blog\/index.php\/2009\/01\/25\/trial-court-must-rule-on-admissibility-of-defendants-priors-before-heshe-hits\/","title":{"rendered":"Trial Court Must Rule on Admissibility of  Defendant&#8217;s Priors BEFORE He\/She Hits"},"content":{"rendered":"<div>In an artful and learned opinion by Justice Kilbride the Illlinois\u00a0<span id=\"lw_1232913598_0\" class=\"yshortcuts\">Supreme Court<\/span>\u00a0ruled in two consolidated cases on 1\/23\/09 that a trial court&#8217;s &#8220;failure\u00a0to rule on a\u00a0<span id=\"lw_1232913598_1\" class=\"yshortcuts\">motion in limine<\/span>\u00a0on the admissibility of prior convictions when it has sufficient information to make a ruling constitutes an abuse of discretion. \u00a0When applying the Montgomery rule before trial a trial judge will certainly be able to determine whether the prior crime was punishable by death or imprisonment in excess of one year, or involved dishonesty or\u00a0<span id=\"lw_1232913598_2\" class=\"yshortcuts\">false statements<\/span>.\u00a0 Likewise, a trial judge can readily ascertain whether less than 10 years \u00a0has (sic) elapsed since the date of conviction of the prior crime or release from confinement. Moreover, in all but the most complicated cases a judge will have enough information before trial\u00a0to weigh the probative value of admitting the prior conviction against the danger of unfair prejudice to the defendant.&#8221;<\/div>\n<div><\/div>\n<div>\n<div>The ruling was contained in the consolidated cases of P v.
